Conditions of Sale

1. Auction Environment
Participants enter the auction area at their own risk. MAS Power Group (PTY) Limited t/a MAS Auctions (hereafter referred to as “MAS Auctions”) is not responsible for damages or injuries incurred on the premises.

2. Acceptance of Terms
By registering and participating in the auction, all buyers acknowledge that they understand and accept these terms and conditions.

3. Auction Registration and Deposits

  • Full registration is required to bid, involving completion of a registration form.
  • A registration deposit, the amount of which will be listed on our website and displayed at the auction site, is necessary to gain access to the bidding.
  • Refunds for unsuccessful bids will be processed within 2 business days, contingent on bank detail submission.

4. Bidding Process and Auctioneer Authority

  • The auctioneer has full authority to govern the bidding process, including resolving disputes regarding bids.
  • The auctioneer has the right to bid against any bidder up to the reserve price; however, the auctioneer is not permitted to bid above the reserve price.
  • All lots are sold as individual transactions unless stated otherwise.
  • Special conditions for lots will be communicated via announcements or prominent notices.

5. Condition of Goods

  • All items are sold “as-is,” and it is the buyer’s responsibility to inspect items before bidding.
  • MAS Auctions is not liable for unseen defects or variations in descriptions deemed accurate prior to the auction. Bidders acknowledge their satisfaction with the condition upon bidding.

6. Payment and Terms

  • The Purchaser understands and accepts that the bid amount is exclusive of VAT, the Buyer’s premium and any other fees. The total purchase price, including any applicable buyer’s premium and fees, and VAT is due within 24 hours following the auction via EFT or direct bank transfer.
  • Should the full amount payable not be completed by the Buyer within the prescribed period, the deposit is forfeited by the Buyer
  • Cash payments on-site are not permitted. A 4% administration fee applies to any cash deposits.

7. Delivery and Risk

  • Risk transfers to the buyer upon the fall of the hammer. Immediate insurance of purchased items is advised.
  • Items must be collected within 72 hours of the auction unless a different timeframe is specified. Late collections may incur daily storage fees.

8. Storage Fees

  • Items not removed within the specified period will incur a daily storage fee of 1% of their value, with a minimum charge of R100 per lot.

9. Liability and Indemnity

  • Neither MAS Auctions, its agents nor the auctioneer shall be liable for any losses, injuries, damages, or claims resulting from participation in the auction.
  • All participants are responsible for their actions while on the premises.

10. Special Conditions for Motor Vehicles

  • Buyers of motor vehicles must inspect the vehicles and agree that odometer readings may not be guaranteed.
  • Ownership documents must be completed, signed, and submitted before the transfer of any vehicle.

11. Governing Law and Jurisdiction

  • These terms are governed by the laws of South Africa. The buyer consents to the jurisdiction of the Magistrate’s Court unless stated otherwise.

12. Amendments

  • Amendments to these terms require written agreement from MAS Auctions and the buyer.
